1. Agreement to Terms
By accessing or using ProApply (the “Service”), operated by Blindspot Studio LLC, a Wyoming limited liability company (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Description of Service
ProApply is a web-based platform that helps users create, optimize, and manage professional resumes and CVs. The Service includes features such as:
- Importing professional profile data from publicly available LinkedIn profiles
- AI-powered resume optimization and content generation
- Multiple professionally designed CV templates
- AI-enhanced profile photo processing
- PDF export and download
3. Eligibility
You must be at least 16 years old to use the Service. By using ProApply, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
4. Account Registration
To access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5. Payments & Subscriptions
ProApply offers both free and paid features. By purchasing a paid plan, you agree to the following:
- All payments are processed securely through Stripe. We do not store your payment card details on our servers.
- Prices are displayed in USD and are inclusive of any applicable fees unless otherwise stated.
- You authorize us to charge your selected payment method for the fees associated with your chosen plan.
6. Refund Policy
We offer a 7-day money-back guarantee from the date of purchase. If you are not satisfied with the Service, you may request a full refund within 7 days of your payment by contacting us at hello@proapply.co.
After the 7-day period, all sales are final and no refunds will be issued. We reserve the right to deny refund requests that we determine, in our sole discretion, to be abusive or fraudulent.
7. AI-Generated Content Disclaimer
ProApply uses artificial intelligence to optimize and generate resume content. While we strive to produce high-quality, relevant content, you acknowledge and agree that:
- AI-generated content may contain inaccuracies, errors, or content that does not fully reflect your qualifications or experience.
- You are solely responsible for reviewing, editing, and verifying all content on your resume before using it for job applications or any other purpose.
- We make no representations or warranties regarding the accuracy, completeness, or suitability of AI-generated content.
- We are not liable for any consequences arising from your use of AI-generated content, including but not limited to rejected job applications, misrepresentations, or missed opportunities.
8. LinkedIn Data & Third-Party Services
ProApply allows you to import data from your publicly available LinkedIn profile to streamline the resume creation process. By using this feature, you acknowledge that:
- You authorize ProApply to access and process publicly available information from your LinkedIn profile.
- ProApply is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation. “LinkedIn” is a trademark of LinkedIn Corporation.
- We use third-party services to retrieve publicly available profile data. The accuracy and availability of this data depends on LinkedIn's public settings and policies.
- You should only import your own LinkedIn profile data. You agree not to use the Service to scrape, collect, or process other people's data without their consent.
9. User Content & Intellectual Property
You retain ownership of all content you submit to the Service, including personal information, text, and images. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service to you.
All other elements of the Service, including but not limited to the design, templates, code, graphics, and branding, are owned by Blindspot Studio LLC and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
10. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Create resumes containing false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Service, other accounts, or our systems
- Use automated tools, bots, or scripts to access or interact with the Service beyond its intended functionality
- Resell, redistribute, or sublicense access to the Service
- Interfere with or disrupt the integrity or performance of the Service
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the Service settings.
12. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Blindspot Studio LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify, defend, and hold harmless Blindspot Studio LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration administered in the State of Wyoming, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
